In this session we will have two distinct presentations – one on Arbitration clauses and the second with an update on the application of provincial laws to developments on First Nation lands.
Arbitration is often a preferred option for parties who want a quick resolution of disputes so that business can carry forward. However, a poorly drafted arbitration clause may cause more problems, and more delay, than the underlying dispute. In this session, Les Honywill and Hessam Mehrabi will review the most common issues caused by poorly drafted arbitration clauses and provide sample clauses for helping the parties get past the dispute and back to work.
Following that presentation, Chris Roine will be reviewing the application of provincial laws to developments on First Nation lands, including reserves under the Indian Act and Framework Agreement for First Nations Land Management Act, and modern treaties or self-government agreements in British Columbia. The pace and scale of development on First Nation lands is steadily increasing, as is the complexity of projects. In this session he will be providing an overview of key issues relating to financing, taxation, environmental, and infrastructure aspects of major on-reserve developments.
