Kevin Mailloux regularly represents financial institutions as well as alternate lenders, trustees, debtor companies and other stakeholders in insolvency, bankruptcy and restructuring matters. He also works on litigation cases in banking, commercial and real estate law.

 

Kevin has expertise in the field of expropriation law and regularly acts for expropriated parties (including tenants) against different levels of government and public entities.

Prior to studying law, Kevin worked in the North American road transportation industry and was a research assistant to Professor Patrick Dumberry in the field of international investment law.

Experience

  • Acting for National Bank of Canada, first ranking secured creditor and interim lender, in the ELNA Medical Group Inc. et al. CCAA proceedings, being a group of related debtors having multi-provincial operations in the healthcare industry.
  • Represented Amsino International Inc. in the acquisition of MedXL Inc. and Liebel-Flarsheim Canada Inc., Canadian manufacturers of medical devices, as part of MedXL Inc. et al.'s CCAA proceeding.
  • Acted for National Bank of Canada, first ranking secured creditor (depending on the entity) and co-interim lender, in the Xebec Adsorption Inc. et al. CCAA proceedings, being a group of related debtors having multi-provincial and cross-border operations.
  • Acted for Bank of Montréal, first ranking secured creditor, in the appointment of an interim and national receiver to Leading Edge Geomatics et al, a group of related debtors having multi-provincial and cross-border operations.
  • Acted for The Bank of Nova Scotia, first ranking secured creditor and interim lender, in the Groupe Atis inc. et al. CCAA proceedings.
  • Acted for FMC Lithium USA Corp. / Livent Corporation in the Nemaska Lithium inc. et al. CCAA proceedings.
  • Acted for Universal City Development Partners, Ltd and Universal Studios Licensing LLC in the Cirque du Soleil and al. CCAA Proceedings regarding two complexe contractual structures involving many different parties, relating to two important shows, Blue Man Group Show and Trolls Live Touring Show, which are at stake for Universal in this CCAA File.
  • Acted for Peoples Trust Company in the matter of the receivership of Société en commandite Portage, an entity which operated a residential complex of 10 apartment buildings
  • Acted for Bell Canada in the restructuring proceedings of Primus Telecommunications Canada Inc. and various related entities under the CCAA
  • Regularly acts for the National Bank of Canada in various insolvency and restructuring matters
  • Acted for an alternate lender for the nomination of a national receiver in the health and family sectors
  • Advised the Biennale de Montréal, a non-profit organization focused on disseminating contemporary art to the public, in its restructuring efforts and insolvency proceedings
  • Regularly acts for Licensed Insolvency Trustees (LIT) in various insolvency and restructuring matters.
