Roberto’s practice focuses on all aspects of privacy law, including responding to freedom of information requests, protecting personal health information, complying with federal and Ontario privacy laws, drafting policies and assisting organizations to respond to privacy breaches. Roberto assists clients in all sectors, including the health and municipal sectors, developing privacy compliant models for collecting, using, and disclosing personal information including through mobile applications.

Roberto assists clients with cyber incident response and responding to privacy breaches as well as defending privacy and cybersecurity litigation including claims for intrusion upon seclusion and with proceedings before the Information and Privacy Commissioner of Ontario.

Roberto also has a broad commercial litigation practice encompassing breaches of contract, real property and leasing disputes, and construction litigation. He has represented clients in the Superior Court, Divisional Court and Federal Court as well as in commercial arbitrations.

Roberto assists clients involved in complex construction disputes including those arising from the interpretation of contracts, delay claims, payment disputes and professional liability issues. He has represented clients at mediations, arbitrations and in the Superior Court.

Roberto also provides health law advice on a wide range of issues and regularly assists health sector clients with medical malpractice litigation, and cases before the Human Rights Tribunal, regulatory colleges, and the Health Professions Appeal and Review Board. He acts as a trusted advisor to health care organizations, municipalities, and corporations, and assists clients with risk management ahead of litigation as well as providing support during litigation in variety of areas including potential and actual commercial disputes, construction disputes and issues arising from leases or contested property ownership.

He routinely advises health sector organizations on their obligations under Ontario’s Personal Health Information Protection Act, 2004, including providing opinions on data sharing and drafting data sharing agreements, privacy policies and procedures.
