Marc-André is a specialized dispute lawyer in the insurance sector and in the professional liability and construction sector. His practice also involves defending insurers in class action proceedings and defending products manufacturers. With a strong background in construction, Marc-André acts for various clients from the construction industry, with a focus on engineers’ professional liability.

He acts for insurers and insureds in the context of complex insurance coverage disputes or in defending liability claims stemming from insurance losses. Marc-André has argued before all level of Courts in Québec in the context of small or large claims. He has handled countless depositions and mediations over the years, working to achieve the objectives his client set out for the file.

Marc-André has been actively involved in the various class actions initiated against insurers in the wake of COVID-19, including in the milestones matters in Québec and Ontario, namely the Gendron Court of appeal ruling in Québec and the Workman Optometry Superior Court decision in Ontario.

Marc-André taught insurance law at University of Montréal in 2022. He also heads the specialized insurance coverage sub-group in the Montréal office of BLG.

Marc-André provides continuous and frequent training sessions to various insurers or insurance market participants.

Experience

  • Represents insurers and insureds in complex class action or cyber insurance coverage determinations, or in high value coverage disputes in the property and casualty space.
  • Defends insurers in class action proceedings, notably in the recent Centre de santé dentaire Gendron Delisle inc. La Personnelle, assurances générales inc., 2021 QCCA 1758 and Tessier c. Economical, compagnie mutuelle d'assurance, 2023 QCCA 688.
  • Provides counsel and compliance review in relation to Bill 96 impacts for insurers.
  • Acts for engineers in professional liability or fees disputes and provide general counsel and opinion to the industry on new regulations impacting engineering firms.
  • Represents developers, contractors, sub-contractors, suppliers of materials and insurers in construction-related disputes and losses.
  • Has particular experience in bodily injury claims, particularly those connecting with the safety of facilities, manufactured goods and/or buildings.
