Identifying privilege for business communications can be a complex area. Are internal emails protected by solicitor client privilege because in-house counsel was copied on them? Does marking a letter “without prejudice” mean that its contents can never be disclosed in subsequent litigation? Does the fact that an internal investigation was conducted at the instruction of counsel mean that all investigative materials are cloaked in privilege?
