Executive Summary

Ouassim Tadlaoui is a member of the Financial Services Group in the Montréal office. As a litigator, his practice focuses on banking litigation, civil and commercial litigation, bankruptcy and insolvency, professional liability, as well as construction law.

Within the Financial Services Group, Ouassim represents banks, other financial institutions and alternate lenders as creditors, as well as certain debtors in cases of recovery, bankruptcy and corporate restructurings. He also represents and advises bonding companies, as well as general contractors and sub-contractors in matters of insolvency, bankruptcy and restructuring in the construction industry.

Ouassim has pleaded before various decision-making bodies, including commercial arbitrators, the Superior Court of Québec (Civil and Commercial divisions), as well as the Court of Appeal of Québec.

Representative Work

  • Represented Aviva Canada Inc. (Aviva), a surety company, in the CCAA filing of Hexagone, one of the largest civil engineering construction company in the province of Quebec and at the time of its insolvency had over one hundred construction sub-contracts with regards to numerous construction projects at different stages of completion.
  • Represented Bank of Montreal and Laurentian Bank in several collection files, with regards to debtors in various industries such as Pharmacies, Shoe Retail company and software and special effects engineering company.
  • Represented Next Gear Capital Corp, an important alternate lender in the Automotive industry in connection with collection and insolvency matters.
  • Represented R&D Capital, an important alternate lender specializing in tax credits in scientific research and experimental development (SR&ED), multimedia, e-business development (TCEB), film production or mining exploration, with collection and insolvency matters.
  • Represented in CCAA proceedings Groupe UNNU-EBC LLP and EBC INC., secured creditors holding construction liens over the assets of The Bloom Lake Iron Ore Mine Limited Partnership.
  • Advises financial institutions, creditors, receivers, monitors and trustees, and defends their interests before the courts in matters pertaining to realization on security, bankruptcy, corporate restructuring, asset recovery and liability suits.
  • Advises debtor companies and parties interested in matters of restructuring and insolvency.
  • Represents contractors, sub-contractors and bonding companies with respect to issues pertaining to the construction industry and more specifically, bonding issues.
