Executive Summary

Kate Menear is a partner in the Commercial Litigation Group in BLG’s Toronto office. Kate is an experienced litigator with a broad based commercial litigation practice, which includes expertise in the retail and telecommunications industries as well as the emerging cannabis market. She regularly advises large Canadian corporations with respect to a wide range of complex commercial disputes. Kate also has expertise in extraordinary remedies including Anton Piller (civil search) and Mareva (asset freezing), as well as injunction proceedings. She was seconded to a client for a term, where she gained valuable direct insight into the issues faced by in-house legal teams.

Kate has attended motions, appeals, mediations and trials. She has appeared as counsel before the Ontario Court of Appeal, Ontario Divisional Court and Superior Court of Justice. Kate regularly advises large Canadian corporations in respect of a wide range of commercial disputes.

Representative Work

  • Represented a large Canadian convenience store retailer with regulatory issues and commercial, employment, human rights, municipal, real estate, environmental and insurance disputes related to tobacco and gaming
  • Represented a major Canadian grocery chain in defence of action by a supplier of jewelry products, and in defence of action by a liquor licensing board in regards to lost profits during shut down of store location
  • Represented a major Canadian grocery chain in defence of action by a supplier for lost profits and misappropriation of opportunity
  • Involved in designing and executing anti-piracy litigation strategies across Canada for satellite television providers and an encryption technology provider
  • Represented a retail pharmacy in arbitrations to collect on outstanding monies owed and defended against claims of violation of the pharmacy legislation and regulations
  • Defended an automotive supplier in a long standing dispute regarding breach of a licence agreement and misappropriation of airbag and steering wheel technology
