Executive Summary

Ewa is focused on solving her clients’ most complex and sensitive problems. She provides strategic advice to businesses, institutions and individuals who are facing or are trying to avoid litigation.

Ewa has a diverse practice, working with clients across a broad range of industries, in areas such as corporate commercial litigation, estates litigation, energy litigation, appellate advocacy, judicial review and public law. Ewa’s breadth of experience means she is able to find creative and insightful solutions to problems faced by clients.

Ewa is the co-chair of the Appellate Advocacy Group and has argued appeals at the Ontario Court of Appeal and appeared numerous times for interveners before the Supreme Court of Canada.

Prior to joining BLG, Ewa served as law clerk to the Honourable Justice Rosalie Silberman Abella of the Supreme Court of Canada.

Ewa is fluent in both French and Polish.

Representative Work

Public Law and Appellate Work – represented public interest groups and institutions on precedent setting decisions

  • Counsel before the Supreme Court of Canada for the Canadian Civil Liberties Association on the availability of habeas corpus to immigration detainees to challenge their detention (decision on reserve).
  • Counsel before the Supreme Court of Canada for the HIV AIDS Legal Clinic Ontario and the Income Security Advocacy Centre in S.A. v Metro Vancouver, a case that addressed the use and merits of Henson trusts for persons with disabilities (decision on reserve).
  • Counsel for Humber River Regional Hospital on the constitutionality of the common law definition of death Ouanounou v Humber River Hospital et al.
  • Counsel before the Supreme Court of Canada for the Canadian Chamber of Commerce and the Canadian Federation of Business at the Supreme Court of Canada in R v Comeau, a decision that dealt with interprovincial trade of beer.
  • Counsel before the Supreme Court of Canada for the Canadian Civil Liberties Association in Amaratunga v. Northwest Atlantic Fisheries Organization on the jurisdictional immunity of international organizations.
  • Counsel before the Supreme Court of Canada for the Muslim Canadian Congress in R v. N.S. on the right of a woman to wear a niqab while testing at trial.
  • Counsel for Ontario Shores on the constitutionality of certain criminal code provisions Kobzar (Re).
  • Defended successfully a municipal councillor against conflict of interest allegations – Lorello v Meffe.

Estates Litigation – represented clients involved in contentious estates disputes

Recognizing the emotional complexity of estates matters, Ewa focuses on finding solutions to resolve estate disputes while at the same time holding those in positions of trust to account.
Ewa has expertise in the following types of estate disputes:

  • Responding to a Will challenge – Counsel for estate trustee before the Court of Appeal for Ontario in Neuberger v. York on the novel issue of whether estoppel applies in Will challenges.
  • Pursuing advisors, attorneys for property and trustees who are alleged to have defrauded beneficiaries.
  • Obtaining advances on equalizations of net family property - Skrobacky v. Frymer.
  • Shareholder disputes in private and closely held corporations - Trezzi v Trezzi.
  • Dissolution of a real estate partnerships – Nasjjec v Nuyork.
  • Contested passings of account – Vano (Re).

Energy Sector Litigation

Ewa provides both strategic advice to energy sector clients and litigation advice, including on complex matters before the Ontario Energy Board.

Many of the disputes on which Ewa has acted have been resolved through confidential arbitration and are therefore not publishable.

Ewa is the editor in chief of "The Exchange: BLG's Financial Institutions Litigations Blog". This Blog is geared towards issuers, dealers, insurance and trust companies, banks and other financial institutions.
