There are significant differences between Canada’s new anti-spam and online fraud act (“CASL”) and the American CAN-SPAM Act. CASL establishes one of the strictest anti-spam regimes in the world, with restrictions and requirements (including opt-in consent) that are far more onerous than those under CAN-SPAM. American organizations that send commercial electronic messages to recipients in Canada should understand the differences between CAN-SPAM and CASL so that they can prepare for compliance with CASL.(...)
