The court allowed the Applicant's motion to confirm the decision of an arbitration panel and rejected the Defendant's petition to quash the panel's decision. The Defendant objected to the decision on the basis that the arbitrators should have declared themselves without jurisdiction despite the fact that it was the Defendant who insisted that the dispute should be subject to arbitration. The court found that the Defendant had acknowledged the Arbitrators' jurisdiction. Costs were awarded to the Applicant.
