Purpose of Role

The Commercial Litigation Paralegal’s primary purpose is to provide support to the Group and contribute to the overall excellent level of service provided to our clients.

Key Responsibilities

The key responsibilities of this role are:

  • Reviewing documents sent by clients or others, to examine their facts and determine their usefulness in the litigation;
  • Drafting and preparing proceedings, including, notably, originating applications or in the course of proceedings, case protocols, requests for setting down for trial and judgment, notice of appeal, and other various proceedings, etc.;
  • Drafting and preparing documents relating to hypothecary remedies: prior notices, notices of withdrawal of authorization to collect receivables (or rents), application for forced surrender, etc.;
  • Drafting and preparing seizure before judgment proceedings;
  • Following pre-trial examinations: follow-up on undertakings to produce, communications with clients or other to obtain undertakings, compilation and organization of undertakings;
  • Preparing summaries of examinations;
  • Performing computerized searches of REQ, RPMRR, Office of the Superintendent of Bankruptcy, Bank of Canada, plumitif (court records), land registry offices, Equifax, etc.;
  • Obtaining investigation reports from private investigators;
  • Registry office registrations;
  • Case law research and drafting of research memoranda transmitting research results; updating lists of authorities;
  • Organizing and digitizing complex and voluminous litigation files; assisting lawyers at meetings by taking notes and following up re: documents;
  • Serving as an intermediary with clients or third parties to obtain information and answer client’s questions, depending on the limitations of his/her role;
  • Preparing litigious cases for trial: checking files re: preparation of subpoenas; ensuring originals of exhibits are on hand; organizing the list of authorities; ensuring exhibits of adverse parties are on hand;
  • Preparing instructions for bailiffs re: execution of judgments and following up with bailiffs in such matters.

Key Competencies Required

  • College diploma (D.E.C.) in Paralegal Technology;
  • 5+ years’ experience as a paralegal, preferably in a law firm.
  • Effective communications skills;
  • Ability to work independently and in a team;
  • Ability to work under pressure and meet deadlines;
  • Ability to respond to clients in a courteous and professional manner;
  • Knowledge of relevant and current government statutes and regulations;
  • In-depth knowledge of legal terminology;
  • Ability to prioritize and reset priorities if necessary;
  • Ability to manage stress in a professional manner;
  • Proficiency in French and English (oral and written);
  • Knowledge of the Microsoft Office suite;
  • Knowledge of Relativity, an asset;
  • Meticulousness with a concern for detail.
