Purpose of Role

The Litigation Law Clerk’s primary purpose is to provide support to the Commercial Litigation Group and contribute to the overall excellent level of service provided to our clients.

Key Responsibilities

The key responsibilities of these roles include, but are not limited to:

  • File management from inception to conclusion
  • Electronic/paper organization and maintenance of files
  • Drafting originating applications, Statements of Defense and other pleadings, interlocutory proceedings and motion materials
  • Identifying, requesting and monitoring lists of required productions and information from both the client and opposing counsel
  • Preparing electronic document briefs, charts, chronologies and summaries of documentary evidence for use on discovery, mediation, pre-trial and arbitration/trial
  • Analysis of client documents and preliminary drafting of the Affidavit of Documents, including identification of Schedule “A”, “B”, “C” & “D” (where applicable) productions
  • Reviewing and summarizing transcripts of examinations; managing undertakings and refusals
  • Compiling books of authorities and other briefs
  • Preparing mediation and pre‑trial briefs
  • Preparing documentation required for appeals including books of authorities, compendium materials, and assisting with preparation of facta
  • Arranging and participating in meetings with experts
  • Compiling statistics and information, and performing research tasks
  • Preparing bills of costs
  • Hearing and trial preparation
  • Maintaining a bring-forward system to: ensure team members have everything required for scheduled meetings, discoveries, mediations, arbitration hearings or Court appearances; and
  • Cooperating within the team to assist with overflow, urgent deadlines and back-up coverage.

Key Competencies Required

  • Minimum 1 to 3 years litigation law clerk experience
  • Knowledge of Rules of Civil Procedure, Federal Court Rules and statutes
  • Community College Law Clerk Diploma or Institute of Law Clerks of Ontario Certificate (or equivalent)
  • Eligible for membership as an Associate Member of the Institute of Law Clerks of Ontario
  • Proficient in MS Office
  • Knowledge of Relativity software an asset
  • Professional demeanor and strong organizational, investigative, fact‑finding, and problem-solving skills
  • Ability to process a high volume of documentation with excellent attention to detail
  • A team player attitude with excellent communication and interpersonal skills for liaising with clients, lawyers, investigators, experts, and staff.
