Executive Summary

​François Joli-Coeur is an associate in our Privacy and Data Protection practice group. He advises and assists international and domestic clients from various sectors on a wide range of issues, including privacy and anti-spam, information technology, telecommunications (including CRTC regulatory requirements), advertising, marketing and sponsorship, consumer protection, cybersecurity issues and data breach management. François regularly deals with access to information requests and with the preparation of license agreements for clients from various industries.

François received a bachelor's degrees in civil law from University of Montreal and a Master of Laws degree from University of California, Berkeley with a specialization in technology law. He also more recently received a graduate diploma in e-business (DESS) from HEC Montreal.

Prior to joining the firm, François worked for a Canadian leader in telecommunications, entertainment, news, media and culture, where he took part in telecommunications and broadcasting proceedings before the CRTC, supported the marketing, technology and operation departments with compliance issues, and with the preparation and negotiation of commercial agreements.

François has authored and contributed to various publications pertaining to privacy, technology and copyright law. He previously acted as associate editor for the Berkeley Technology Law Journal. He is co-author of the Online Advertising and Linking module of Lexis Practice Advisor Canada.

François is fluent in French and English.

Representative Work

  • ​Has advised a federal public sector organization, an important retailer and a professional services firm in the context of data security breaches involving different Canadian jurisdictions. Has assisted the clients in assessing the obligation to notify individuals of the breaches and drafting notification letters.
  • Has advised various clients about the legal risks related to the management of personal information, including in the context of online advertising, big data projects, cloud computing and outsourcing.
  • Has provided advice on Anti-Spam Legislation requirements to various clients, including software developers, large online and physical retailers and an automobile manufacturer.
  • Has assisted a multinational company in an investigation carried out by the Office of the Privacy Commissioner of Canada concerning the management of anonymized personal information.
  • Has assisted an employer in an investigation carried out by the Commission d'accès à l'information du Québec in connection with a claim of unauthorized access to employee personal information.
  • Has drafted various policies and procedures, such as online privacy policies, policies governing the use of employers' equipment by employees and privacy breach response procedures.
  • Has advised clients on the collection of biometric information, drafted the required consent agreement and prepared documentation required by the Commission d'accès à l'information du Québec.
  • Has advised clients on cross-border requirements for employee data and drafted relevant policies.
