Executive Summary

Clay Jacobson is a partner in the Commercial Litigation group in the Calgary office. Clay represents commercial clients in a number of sectors including energy, transportation, retail and manufacturing in litigious disputes and regulatory proceedings arising from their operations.  Clay has appeared before all levels of court in Alberta as well as the Federal Court of Canada and Federal Court of Appeal.

Representative Work

  • Acts for a number of oil and gas companies in proceedings before the Court of Queen’s Bench and the Alberta Energy Regulator related to operations, service and supply contracts, gas processing allocations, and environmental issues.
  • Represents employers in claims against former employees arising from breaches of non-competition provisions, fiduciary obligations and duties of fidelity, and in defence of wrongful dismissal claims.
  • Counsel to multiple railway companies in defence of complex multiparty tort actions arising from right-of-way fires.
  • Acts in numerous cases involving general commercial matters including contractual disputes, debt actions, shareholder disputes, negligence actions, product liability claims, occupier’s liability claims and insurance coverage issues.
  • Acts for members of the RCMP in relation to judicial review applications before the Federal Court and Federal Court of Appeal.
