Executive Summary

Duncan Ault is a partner in our Ottawa office. His practice focuses on civil litigation with an emphasis on corporate commercial litigation including contractual disputes, securities litigation, shareholder disputes, class actions, commercial arbitrations, and directors’ and officers’ liability. Duncan has appeared before all levels of court in Ontario, the Québec Court of Appeal, and the Supreme Court of Canada.

Prior to joining Borden Ladner Gervais LLP, Duncan practised litigation in the Toronto office of a national law firm for five years. During his articles, Duncan was seconded to the Enforcement Branch of the Ontario Securities Commission.

Representative Work

  • Counsel before the Ontario Court of Appeal and the Ontario Divisional Court for the Law Society of Upper Canada in Trinity Western University v. The Law Society of Upper Canada.
  • Counsel before the Federal Court of Appeal for Canadian National Railway Company against the Canadian Transportation Agency in two appeals challenging the Agency's revenue cap determinations for transportation of grain.
  • Counsel before the Ontario Superior Court for Canadian National Railway Company in a contractual dispute with the City of Thunder Bay.
  • Represented an international media company in a complex commercial arbitration involving a wide range of issues, including a dispute over certain post-closing working capital adjustments.
  • Represented a Canadian bank in pre-certification, certification and settlement stages of a large class action involving historic foreign exchange transactions on credit cards.
  • Represented Canwest Global Communications Corp. in its restructuring under CCAA proceedings.
  • Acted as Commission Counsel in the Elliot Lake Commission of Inquiry.
