Canada is considering becoming a member of an international trade-mark registration system, namely, the Protocol Related to the Madrid Agreement Concerning the International Registration of Marks (the “Madrid Protocol”). As expected, the adoption of this registration system offers advantages as well as disadvantages for Canadian businesses. While there are others whose interests may be at stake, such as those entering the marketplace with a new trade-mark, this article considers the impact of adoption of the Madrid Protocol from the perspective of established businesses.
