The Ontario government’s introduction of the new Ontario Health Premium in its 2004 Budget has caused significant debate over whether employers are responsible for paying the Ontario Health Premium on behalf of their collectively bargained employees. Although the Ontario government has expressly stated that employees are responsible for paying the new Ontario Health Premium, at least one arbitrator has ruled that a dormant collective agreement provision requiring payment of Ontario Health Insurance Plan premiums also require employers to pay the new Ontario Health Premium.
