In the April 2003 decision in Canadian Real Estate Association v. Sutton (Québec) Real Estate Services Inc., the Québec Superior Court issued a pre-trial injunction prohibiting the scraping (data mining) of a website in violation of the website's terms of use. The decision is consistent with other cases holding that properly implemented website terms of use can be valid and binding, even though users are not required to click an "I Agree" icon.
