In Concord Industrial Services Ltd. v. 371773 B.C. Ltd., the British Columbia Supreme Court dismissed a plaintiff’s action for a claim of builders’ lien on the basis that the plaintiff failed to file the claim of lien on a timely basis as required under the Builder’s Lien Act. More importantly, however, the Court awarded special costs to the defendant on the grounds that the conduct of the plaintiff in bringing its claim of lien was reprehensible.
