Changes to Employment Standards Legislation
In our June 2002 Labour and Employment Alert we highlighted various changes to the Employment Standards Act (the “ESA”) introduced by the Employment Standards Amendment Act, 2002 (the “Amendment Act”).
Several changes went into effect on the date the Amendment Act was passed by the Legislature (May 30, 2002). Other provisions – including those respecting averaging agreements, overtime, statutory holiday pay, mandatory penalties, and appeals – were left to be brought into force by regulation. On November 22, 2002, the Ministry of Skills Development and Labour promulgated a new regulation, Regulation 307/2002 (the “2002 Regulation”), bringing the remaining amendments into effect on November 30, 2002.
The 2002 Regulation also amended existing ESA regulations (the “Regulations”).
