In the April 2002 decision in Law Society of British Columbia v. Canada Domain Name Exchange Corporation, 2002 BCSC 1249, the Supreme Court of British Columbia issued a pre-trial injunction prohibiting the use or transfer of certain domain names that allegedly violate the Law Society’s common law trademark rights. The Court followed previous authorities holding that the registration and use of a domain name that incorporates another person’s trademark can constitute an unlawful passing off.
