In the April 2002 decision in Reference re Earth Future Lottery, 2002 PESCAD 8, online: http://www.gov.pe.ca/courts/supreme/reasons/923.pdf, the Prince Edward Island Supreme Court - Appeal Division held that a proposed charitable Internet lottery violated the gaming provisions of the Canadian Criminal Code. On a reference from the P.E.I. government, the Court held that the Criminal Code prohibits Internet lotteries directed or made available to purchasers outside the province, and the proposed lottery was therefore unlawful.
