Executive Summary

Jamie Mills practises in all areas of intellectual property law, including prosecution and litigation of patents, trademarks and copyrights, with a primary focus on pharmaceutical patent litigation. A partner and patent agent in the Ottawa office of Borden Ladner Gervais LLP, Jamie also has significant experience in Internet pharmacy issues, pharmaceutical regulatory law, and government relations for innovative pharmaceutical and biopharmaceutical industries.

Jamie is an advocate before the Supreme Court of Canada, the Ontario Courts, the Federal Courts, the Patented Medicine Prices Review Board, the Trademarks Opposition Board, and the Patent Appeal Board. He frequently speaks on issues relating to intellectual property litigation, particularly in the pharmaceutical and biotechnology areas. In addition, Jamie is an appointed Fellow of the Litigation Counsel of America. 

Representative Work

  • Has appeared before the Federal Court and the Federal Court of Appeal.
  • Acting as counsel for innovator companies in proceedings brought pursuant to the Patented Medicines (Notice of Compliance) Regulations.
  • Acting as counsel in patent infringement and patent impeachment actions.
  • Acting as counsel in trademark infringement and expungement proceedings.
  • Acting as counsel in a copyright infringement action.
  • Acting as counsel for innovator companies in judicial review proceedings relating to listing of patents on the Patent Register.
  • Advising clients with respect to data protection, listing patents on the Patent Register and reporting patents to the Patented Medicine Prices Review Board.
