Executive Summary

Anne Merminod's practice consists primarily of class action defence work, as well as product liability and insurance litigation on a wide range of consumer protection claims. Anne currently defends numerous companies in various consumer protection and product liability class actions, both at certification and on the merits. She also defends various class actions in other areas of law, notably for breaches of privacy and price-fixing class actions. She has also considerable experience in the settlement of class actions.

Anne Merminod also represents Canadian and foreign clients in major commercial litigations, including cases relating to insurance, manufacturers' liability, consumer law, fraud and competition law. Anne regularly appears at the Superior Court and the Court of Appeal.

Anne Meminod defends numerous companies in a wide variety of class actions of both a national and provincial scope, at the authorization stage, on the merits and/or in settlement negotiations.

Class Action – Consumer Protection

  • Hébert v. Kia Canada Inc. – Defeated certification on behalf of Kia Canada in the defective Bluetooth system class action. The court upheld the decision in appeal.
  • Martel v. Kia Canada inc. – Class Action involving alleged false representations regarding maintenance intervals in the owners' manuals.
  • Grandmaison v. Mazda Canada inc. – Class Action based on alleged false representation regarding the fuel consumption of vehicles.
  • Rabin v. Hewlett Packard Canada Co. – Class Action related to HP printers rejecting non-compatible cartridges.
  • Benabu v. JP Morgan Chase – Class Action alleging that 25 respondents violated the Consumer Protection Act by providing free trials to customers or promotional offers and continuing to bill them at full price at the end of the promotional period.
  • Volkswagen – Successful resolution of the Volkswagen emission class action which was approved by the Ontario and Québec Superior courts. This resolution is the largest consumer product settlement in Canada.
  • Abicidan v. IKEA Canada Limited Partnership & al. – Class Action regarding the alleged defective chest of drawers that were involved in a recall by Health Canada.
  • Fortin v. Mazda Canada – Product liability Class Action on the merits based on an alleged problem with door locks.
  • Petrella v. Osram Sylvania Inc. – Class Action in Québec and Ontario regarding the alleged Automative Lighting Products.

Class Action – Privacy law

  • Lamoureux v. Investment Industry Regulatory Organization of Canada (IIROC) – Breach of privacy class action.
  • Sofio v. Investment Industry Regulatory Organization of Canada (IIROC) – Obtained the dismissal of the appeal from the judgment dismissing Mr. Sofio's class action against IIROC, following the loss of personal information of 50,000 investors.

Class Action – Competition Law

  • Jacques v. Provigo & all. – Competition law class action regarding the alleged fuel cartel between gas stations in Sherbrooke, Magog, Thetford Mines and Victoriaville.
  • Cartise v. British Airways – Competition class action regarding the alleged cargo fees cartel between several air lines.

Class Action – Pharmaceutical and Health Law

  • Paquin v. Sorin, Livanova & all – Class Action against the manufacturer of the cardiac leaking and cooling system.
  • Partouche v. Lachine Hospital – Class Action regarding the bariatric surgeries.
  • Kelly v. Dr Bourdon and Lakeshore General Hospital – Class Action regarding the colonoscopies recall.
  • Larose v. Purdue Pharma inc. & all – Class Action regarding the alleged addiction, abuse and overdose of Oxycontin.

Class Action – other

  • Bélisle v. Volkswagen – Environmental Class Action regarding the alleged emissions of nitrous oxide of Volkswagen vehicles. 
  • Segalovich v. C.S.T. Consultants inc. & all – Class Action regarding the business of distributing, promoting and sponsoring of Registered Education Savings Plans.
  • Maxwell v. Shoppers Drug Mart Inc./Loblaws & all – Class Action regarding the alleged practice at differentiating prices according to the gender of the consumer, commonly referred to as "pink tax".
  • Berdah v. Kiewit/Parsons & all – Class Action regarding the Turcot interchange.
