Executive Summary

Ian Mathany is a lawyer in the Toronto office of Borden Ladner Gervais LLP. His practice is focused mainly on municipal law, with an emphasis on planning and development law and expropriation law. Ian appears frequently at the Ontario Municipal Board (OMB) in planning and expropriation cases and at the Board of Negotiation in expropriation cases.  Ian also has experience in real estate civil litigation, procurement law, regulatory compliance matters, and municipal licencing. Ian is the Vice-President and a Board Member of the Ontario Expropriation Association.

Representative Work

  • Acts as counsel in proceedings before the OMB, Board of Negotiation, all levels of Ontario's court, and mediators and arbitrators.
  • Represents public sector clients, including local and upper tier municipalities in planning and expropriation matters throughout southern Ontario. 
  • Represents private sector clients in a diverse range of planning matters and development matters throughout Ontario, including submission of development applications; filing appeals; assembling consultant teams; negotiations, presentations and mediations; and committee of adjustment appearances and OMB hearings.
  • Provides expropriation process and litigation services to expropriating authorities, typically municipalities and transit authorities.  Sample municipal projects include local and regional transit and road projects; sanitary and water service infrastructure.
  • Acts for landowners in expropriation claims against the Province and municipalities, typically in relation to provincial Highways such 407, 400, 404, 427, 69, 11-17, rapid transit projects or hydro corridors.
  • Provides regulatory advice for private section clients on gaming and licencing matters.
  • Provides procurement law advice to private entities, including drafting RFPs, RFQs and other forms of tender documents, and providing ongoing advice throughout the procurement process and with respect to the resolution of procurement disputes.
