Executive Summary

Mark Lewis practises in the areas of real estate development, commercial lending and commercial real estate leasing, with an emphasis on residential, commercial and resort developments, and commercial financing transactions.

Having worked on numerous projects for developers and lenders, Mark has extensive experience in the following areas: structuring co-ownership, joint venture, limited partnership and limited liability partnership relationships for real estate development projects; representing institutional lenders in real estate financing transactions; representing private capital lenders in connection with mezzanine, equity and profit participation loans; representing surety companies in deposit protection insurance transactions; representing both landlords and tenants in commercial, retail and industrial leasing transactions and advising clients with respect to zoning, bylaw and other real estate regulatory compliance matters.

Mark also has extensive experience in the investigation, acquisition and transfer of government land tenures and sale / lease-back transactions involving industrial properties, including port leases and subleases, and properties with substantial environmental concerns.

Representative Work

  • Acts for developers of high-rise condominium projects, including mixed-use projects with airspace parcel subdivisions, as well as low-rise condominium and townhouse developments.
  • Has represented several developers and owners of golf, skiing or marina-based resort developments, in all regions of British Columbia, in connection with the acquisition, subdivision and development of their lands, including negotiation of long-term development and servicing agreements.
  • Advises institutional and non-institutional lenders in connection with construction and equity financing of real estate investments and development projects.
  • Represents several seniors housing owners and operators, including a large national seniors’ housing real estate investment trust (REIT), in connection with their acquisition, disposition, development and financing transactions.
  • Represents retail operators, including a major national grocer, in connection with acquisition and development matters, including reciprocal agreements related to development, access, use and cost-sharing with adjoining owners.
  • Created and implemented British Columbia’s first deposit insurance program for Canada’s largest provider of home warranty and deposit insurance products.
  • Represents transportation, mining and forestry clients with industrial land portfolios in connection with acquisition of new properties, subdivision of existing lands and disposition of portfolio and individual assets.
  • Has advised chartered banks and other lenders on revisions to their standard mortgage terms to address “plain language” and legislative update issues.
  • Advises offshore investors from Malaysia, Philippines and India and China on real estate investments in Canada.
