Executive Summary

Christel Higgs is a partner in the Toronto office of Borden Ladner Gervais LLP. Christel has practised with BLG since joining us as a summer student in 2005. She practises real estate litigation, with a particular focus on municipal, expropriation, land use planning law, and contract and commercial lease disputes. She represents both municipalities and private landowners.

Christel's practice encompasses a broad scope of real estate litigation work, including assisting in title investigation, ground lease negotiations and litigation, drafting pleadings, engaging in settlement discussions and attending the Ontario Municipal Board, Superior Court, and arbitration panels. Over the last several years, Christel has been involved in the litigation of multiple, lengthy and complex cases at the Ontario Municipal Board and before arbitration panels.

Representative Work

  • Acts for both private landowners and public authorities.
  • Appears at the Ontario Municipal, Superior Court, Committees and Community Council.
  • Represent both landowners and municipalities at Hearings of Necessity, Boards of Negotiations and the Ontario Municipal Board to determine compensation in expropriation proceedings.
  • Represents a regional municipality in expropriations for various arterial road improvement projects.
  • Represented a regional municipality in the expropriation of over 200 properties for the purposes of developing rapid transit.
  • Represented private landowner against the Ministry of Transportation over a disputed expropriation in the City of Thunder Bay.
  • Represented multiple landowners in the Windsor-Essex Parkway expropriation.
  • Represented municipalities at the Ontario Municipal Board in Growth Plan conformity cases, defending municipal Official Plans.
  • Represented a private landowner in valuation case before arbitration panel, resulting in $220 million finding in favour of the client.
