Executive Summary

Daniel Girlando provides legal advisory and dispute resolution services to hospitals, healthcare facilities, and hospital staff with respect to medical malpractice, privacy,  physician privileges, access to information, adverse event management and diverse other issues.  His experience includes defending clients in class actions and civil lawsuits. Daniel also practices employment law, acting for employees or employers in wrongful dismissal claims.

Called to the bar in Ontario and Québec, Daniel obtained his law degree at McGill University where he was actively engaged with the McGill Human Rights Working Group's Access to Medicine Campaign. He also attended the National Law School of India University in Bangalore during a semester abroad, and interned for the UN Special Rapporteur on the Right to Health in Mumbai. Prior to law school, Daniel worked for two years at AIDS Community Care Montreal (ACCM). He is fluently bilingual in English and French .

Representative Work

  • Defends hospital staff in medical malpractice as counsel to the Healthcare Insurance Reciprocal of Canada (HIROC).
  • Represents hospitals facing large privacy breach class actions and acted as co-counsel on the Hopkins v Kay 2015 ONCA 112 case.
  • Act for hospitals before administrative tribunals issues related to the suspension and revocation of physicians privileges.
  • Acts for employees and employers in wrongful dismissal cases (see Paquette c Quadraspec, 2014 ONCS 2431 and Oudin v Centre Francophone de Toronto, 2016 ONCA 514).
  • Advises hospitals and healthcare facilities on a variety of issues, including physician privileges, privacy and the management of patient safety event.
