Raphaël Girard  


Executive Summary

Raphaël Girard is an associate in our Privacy and Data Security practice group in Montréal. He advises and assists international and domestic clients from various sectors on a wide range of issues, including privacy and anti-spam compliance, information technology, telecommunications, advertising, marketing and sponsorship, consumer protection as well as cybersecurity issues and data breach management. Raphaël regularly deals with access to information legislation both at the provincial and federal levels. He has also been involved in drafting privacy policies and license agreements for clients from various industries.

Raphaël received a Master of Laws degree (with Distinction) with a specialism in public international law from the London School of Economics and Political Science (LSE) in 2015 and bachelor's degrees in civil law and common law from McGill University in 2013. He also completed a semester abroad at the Rijksuniversiteit Groningen (University of Groningen), in the Netherlands, in 2012.

Raphaël is fluent in French and English and has a limited proficiency in Spanish.

Representative Work

  • ​Participated in the drafting of a 50-page legal opinion on the legal risks pertaining to analytic research and the use of a newly minted score for underwriting purposes.
  • Conducted a privacy impact assessment for a multinational corporation working in the biopharmaceutical sector.
  • Contributed to a white paper entitled "Privacy above all other Fundamental Rights? Challenges with the Implementation of a Right to be Forgotten in Canada", which explores whether importing a right to be forgotten would be advisable in Canada, submitted to the Office of the Privacy Commissioner as part of their consultation and call for essays on online reputation.
