Executive Summary

Noëlle Caloren has been a member of the Ottawa Office Litigation Department since her call to the bar. She is fluently bilingual in English and French and practises in both official languages.

Noëlle has developed an expertise in employment and labour law through her work for numerous public institutions, notably in the educational, healthcare and municipal sectors and for private sector corporate clients and individuals in the provincial and federal jurisdictions. She assists her clients with employment-related matters involving the preparation of contracts and policies, the negotiation and interpretation of collective agreements, the assessment of termination packages and representation in legal proceedings. Noëlle routinely advises on human rights issues and workplace investigations. She is well versed in health and safety matters and access to information and privacy rights in both the federal and provincial jurisdictions.

As a part-time member of the Ontario Civilian Police Commission for eight years (from September 2004 - September 2012) Noëlle acquired a sound knowledge of administrative law. In this role, she had occasion to preside over disciplinary appeals, public inquiries into the conduct of police service board members and police service disbandment hearings.

Representative Work

  • Appearing as counsel before the Ontario Superior and Divisional Courts, the Ontario Court of Appeal, the Supreme Court of Canada, the Ontario Labour Relations Board, the Human Rights Tribunal, the Workplace Safety and Insurance Board and Tribunal, and the Ontario and Federal Privacy Commissions.
  • Providing solicitor type work on employment matters such as drafting and reviewing executive employment contracts and policies and advising on employee transfers under M&As; assessing severance packages and providing advice regarding employee discipline and termination; providing comprehensive opinions on all manner of contractual and legislative issues.
  • Advising on employment standards and occupational health and safety issues and representing clients in Ministry of Labour investigations, Applications for Review and ministerial prosecution proceedings.
  • Providing advice with respect to human rights, mainly in matters involving discrimination, harassment in the workplace and the duty to accommodate.
  • In the labour context, assessing and providing interpretation advice on collective agreement terms relating to compensation, benefit entitlements, seniority, transfers out of the bargaining unit and contracting out.
  • Assisting clients with and participating in the collective bargaining process, including their representation in interest arbitrations.
  • Addressing matters relating to bargaining unit composition under the Public Sector Labour Relations Transition Act, 1997.
  • Dealing with unfair labour practices and duty of fair representation in proceedings before the Ontario Labour Relations Board.
  • Representing clients at grievance arbitrations.
  • Advising and representing clients in the context of professional disciplinary proceedings.
