Executive Summary

Hugo Babos-Marchand is a member of our Banking and Financial Services and Insolvency and Restructuring groups. His practice encompasses bankruptcy and insolvency law, banking, commercial and securities law litigation, including extraordinary remedies and shareholders' rights disputes.

Hugo regularly acts for various financial institutions, trustees, monitors, receivers, corporations and shareholders. He has represented his clients before all levels of courts in Québec as well as before the Federal Court.

He completed in 2010 a master's degree in law at McGill University for which he was awarded the Aubrey-Senez Bursary. His master's project dealt with the incorporation of Norwich orders in Québec judicial law. Hugo also teaches the course on Priorities and Hypothecs at the École du Barreau du Québec.

Representative Work

  • Acting for the receiver appointed to certain assets of Dominic Lacroix pursuant to an Act respecting the Autorité des marchés financiers. This was the first time a receiver was able to seize cryptocurrency (Bitcoin) in the context of its mandate.
  • Acted for clients in the context of investigations and searches performed by the Autorité des marchés financiers.
  • Acted for a shareholder in the context of a dispute concerning the development of a real estate project located at 1420 Mont-Royal Boulevard, one of the most prestigious condominium projects in Montreal.
  • Acted for Bell Canada in the restructuring proceedings of Primus Telecommunications Canada Inc. and various related entities under the CCAA.
  • Acted for the Business Development Bank of Canada in receivership proceedings for Atelier Ferland Inc.
  • Acted for the receiver of a mining company in connection with a sale of the debtors' assets in the context of proceedings under the Bankruptcy and Insolvency Act.
  • Acted for a client in the Industrial and manufacture industry in connection with its successful restructuring through a proposal under the Bankruptcy and Insolvency Act.
  • Acted for a Pharmaceutical company in connection with the sale of its assets through a Bankruptcy and Insolvency Act Proposal and through Chapter 11 proceedings in the United States.
  • Acted for the trustee in connection to the bankruptcy of Les Automobiles Luc Fréchette & Fils inc.
  • Regularly Acted for the National Bank of Canada in various insolvency and restructuring files.
