THE COURTS: On January 16, 2007, the Ontario Superior Court of Justice considered the duty of care owed by a financial advisor to clients for non-discretionary accounts, and the apportionment of responsibility for failure to heed an advisor’s advice (in Newman v. T.D. Securities Inc. [2007] O.J. No. 139).
COMPLIANCE: On February 27, 2007, the British Columbia Securities Commission issued its findings from a hearing against a registered mutual fund salesperson and registered securities salesperson, and vicariously, the registered securities dealer and mutual fund dealer at which she worked.
