On March 31st, 2005, the Government of Canada identified the final list of products imported from the United States that would be subject to a retaliatory surtax in response to the continued application of the so-called "Byrd Amendment" by the US Government. Beginning May 1st, 2005, Canada will impose a 15% surtax on imported live swine, cigarettes, oysters and certain specialty fish originating from the United States. The release of this list marked the culmination of a public consultation process initiated by International Trade Canada in November 2004. Borden Ladner Gervais LLP acted for various stakeholders in the process.
