The Supreme Court of Canada’s December 18, 2003 decision in Beals et al v. Saldanha et al. deals with the enforceability in Canada of foreign judgments. It confirms that, where there is a real and substantial connection between a claim or the defendant and a foreign jurisdiction, a foreign judgment will generally be enforced in Canada, subject to a few narrow defences.
