In Agra Foundations Ltd. v. Commonwealth Insurance Co., 2001 SKQB 560, the Saskatchewan Court of Queen’s Bench determined that where an insurance policy contains a deductible clause and the scope of that clause is ambiguous, the clause should not apply to legal defence expenses (which are then to be borne by the insurer) unless clearly stated otherwise.
