In a recent decision of the British Columbia Supreme Court, Mr. Justice Bauman considered the effect of an owner’s payment into Court of his maximum statutory liability, pursuant to s. 23 of the Builders Lien Act S.B.C. 1996, c. 45. After he had made the payment, the personal defendant applied for a subsequent Order dismissing the action (and a related action) as against him, relying on s. 23(2) of the Act.
