Toronto (January 13, 2016) — Borden Ladner Gervais LLP (BLG) is pleased to announce it has been recognized by Lexpert® for its involvement in one of the top 10 deals and one of the top 10 business decisions of 2015. BLG played a key role in the creation of Northview Apartment REIT, the largest multi-family real estate transaction to date in Canada, and in the Ontario Court of Appeal's decision in Moore v. Getahun, which struck down a groundbreaking decision that challenged counsel's interactions with experts.

BLG was named a key legal player in the two following Top 10 deals and cases:

  • Northview Apartment REIT — BLG acted for Northern Property Real Estate Investment Trust (NPR), which acquired all of the assets and properties of True North Apartment REIT. NPR also acquired a portfolio of multi-family real estate assets from affiliates of Starlight Investments Ltd., as well as from joint ventures between affiliates of Public Sector Pension Investment Board and affiliates of Starlight. After closing on October 30, 2015, Northern Property changed its name to Northview Apartment Real Estate Investment Trust, and in November commenced trading on the TSX under the symbol NVU.UN. The BLG team was led by Fred R.   • Moore v. Getahun — BLG's John Morris represented The Holland Group as an intervenor in the appeal of Moore v. Getahun, an Ontario Superior Court of Justice decision, which had censured and prohibited counsel from reviewing and collaborating in draft reports by experts in advance of trial. The Holland Group's members are leading practitioners involved in medical practice throughout Ontario. The Group intervened in the appeal to express its view that proper and effective advocacy requires counsel to test and critically evaluate the views of experts in the preparation of their reports for the purposes of testimony in court. In the end, the Ontario Court of Appeal unanimously ruled that there was no impropriety in reviewing and collaborating in draft reports with experts, and that such reports are immune from production unless there is a reasonable basis to suspect that counsel improperly influenced the expert .
