Three BLG Lawyers among Lexpert's Rising Stars

TORONTO, November 26, 2008 – Borden Ladner Gervais LLP is pleased to congratulate Cindy Clarke, Adam Fanaki and Michael Marion on being named by Lexpert as leading lawyers under 40 in the magazine's annual Rising Stars nominations. This honour, which recognizes a select group of lawyers from across Canada, is awarded annually to those who meet the high standard exhibited by Lexpert's nomination criteria. The criteria is focused on a candidate's legal abilities, major accomplishments and also considers interpersonal skills, business acumen and the views of their peers.

About the winners:

Cindy Clarke is a partner practicing in the Health Law Group in BLG's Toronto office. Ms. Clarke's area of practice includes civil litigation with a particular expertise in medical malpractice. The primary focus of her practice is defending hospitals, Community Care Access Centres and their employees in medical malpractice claims.

Ms. Clarke is a member of the Ethics Committee of Mount Sinai Hospital and regularly prepares papers and presents lectures before various groups of health practitioners at conferences sponsored by the Ontario Hospital Association and other private conference organizers. She is a member of the Canadian Bar Association (Ontario) Health Law Section and Civil Law Section, Advocates Society and the Medico-Legal Society and is officer of the Volunteer Board of the Canadian Mothercraft Society.

Adam Fanaki, is a partner practicing in BLG's competition and commercial litigation groups and also holds the position of Special Counsel to Canada's Commissioner of Competition, Ms. Sheridan Scott. In his position as Special Counsel, Mr. Fanaki serves on the Canadian Competition Bureau's Senior Management team, engaging in the development of key legislative and policy initiatives, and assumes responsibilities as strategic advisor to the Commissioner on enforcement matters and major litigated proceedings.

In 2006, Adam was also selected as one of Canada's leading competition lawyers for the third consecutive year by the Chambers Global Guide to the World's Leading Lawyers and appeared on Lexpert's Rising Start list in 2006. Mr. Fanaki has been an Adjunct Faculty Member at Osgoode Hall Law School, York University and The University of Western Ontario - Faculty of Law.

Michael Marion is a partner practicing in BLG's Calgary office and is a member of the firm's Commercial Litigation Practice Group. He is the Calgary Practice Group Leader of the Environmental, Municipal, Expropriation and Regulatory Law Practice Group. Mr. Marion is also involved with the Electricity Markets Practice Group, the Oil and Gas Focus Group, the Commercial Arbitration Focus Group and the Public Law Focus Group.

Mr. Marion has acted as lead and co-counsel on several Calgary and Alberta expropriation matters and has appeared as lead and co-counsel in trial and interlocutory proceedings before the Alberta Court of Appeal, the Alberta Court of Queen's Bench, the Manitoba Court of Appeal and the Manitoba Court of Queen's Bench. He has also acted as lead counsel in corporate oppression and shareholder remedy actions, on behalf of both corporations and shareholders.
