Executive Summary

Amélie T. Gouin is an associate in our Montréal office. Ms. Gouin specialises in commercial litigation and practices mainly in the fields of competition law, advertisement and marketing, injunctions, extraordinary recourses, fraud, intellectual property and real estate law. Ms. Gouin also has a special interest for all litigation regarding false and misleading representations in the advertisement and marketing of products.

Ms. Gouin was admitted to the Barreau du Québec in 2012 after completing her studies in civil law and common law at McGill University. During her studies, Ms. Gouin was Editor and Executive Editor of the McGill Law Journal. She also completed a clerkship in 2010-2011 under the direction of Justices Pierre C. Gagnon and Michèle Monast from the Superior Court of Québec. 

In 2008, Ms. Gouin earned an Honours Bachelor of Political Science degree at McGill University.

Since 2011, Ms. Gouin has been involved in the activities of the Young Chamber of Commerce of Montreal. She has been an administrator on the Board of Directors of the Young Chamber of Commerce of Montreal since 2013, acting as secretary from 2013 to 2016 and now as the president of the Board of Directors.

In 2016, the WXN – Women Executive Network awarded to Ms. Gouin the prize Top 100: Canada's Most Powerful Women in the category TELUS Future Leaders. Ms. Gouin was also a finalist in competing for the title of "Avocat(e) pro bono/implication sociale" at the Young Bar Association of Montréal Gala in 2013.

Representative Work

  • Ms. Gouin prepares documentation used in trials and pleads before various judicial bodies in Québec.
  • She takes an interest in different fields, such as competition law, advertisement and publicity, injunctions, extraordinary recourses, fraud, intellectual property and real estate law. Ms. Gouin also has a special interest for all litigation regarding false and misleading representations in the advertisement and marketing of products, particularly to claims with regards to telecommunications, food law and health.
  • The following is a sample of the most recent mandates which she has handled:
    • An international commercial arbitration in the field of natural health products relating to alleged misrepresentations affecting the sale price of an enterprise.
    • A mediation in a shareholders' dispute in the field of sanitary landfill.
    • Nagravision v. Ali Kizil et al. (Norwich extraordinary remedy)
    • Knights of Columbus v. Yvon Perreault (seizure in revendication and injunction proceedings)
    • Cuisines Laurier Inc. v. Le Groupe Créatech (a dispute concerning the implementation of an integrated management software program for a business)
    • Prelco Inc. v. Le Groupe Créatech (a dispute concerning the implementation of an integrated management software program for a business)
    • Magali Delgado and Frédéric Pignon v. Cavalia Inc. (a dispute concerning false representations made in various contracts)
  • Ms. Gouin was also deeply involved in the case of The Queen v. Luka Rocco Magnotta, accompanying the victim's family throughout the trial.
